Legislative Update 4/12/2024

-The Idaho Legislature adjourned “sine die” on Wednesday.  Governor Little applauded the legislature for their work on funding school facilities, his Idaho Launch program targeting new workforce development training, and tax relief.  Read the Governor’s press release here.

– The Governor wrote a letter to the Legislature on Monday while legislators were on a temporary adjournment.  The letter outlined his concerns over House Bill 398 which the Governor believes will disrupt health care services and payments to medical providers.  The Legislature adjourned without addressing the Governor’s concern as it is the position of the legislature that the bill does not affect waivers that are already implemented.  Read the Governor’s letter here

Legislative Update 3/29/2024

  • Governor Little along with Idaho’s US Senators and Congressmen released a joint statement in response to the VA pulling grant funding for building and renovating Veterans homes in Idaho and across the country. Read the Governor’s statement here.
  • The legislature slowed this week over debate about ITD’s sale of its former headquarters on State Street in Boise. The delay was caused when the Senate failed to pass ITD’s enhanced budget bill for FY 2025.  The failed bill will extend the session until next week.
  • The Medicaid appropriation bill was finally introduced this week, SB 1456. Hopefully it will be passed without a lot of trouble.
  • Both the House and Senate adjourned early today for the Easter holiday. They will not return to finish up until Tuesday, April 2nd.

Legislative Update 3/21/2024

  • Governor Little released a statement applauding the Legislature on passing his “Idaho Works” initiative which provides funding for school facilities while reducing property and income tax.
  • Governor Little also acknowledged the House of Representatives for passing his “Idaho Launch” program that provides graduating seniors up to $8,000 to enter a qualified education or training program. The Launch bill was delayed this week after House Speaker Moyle held the bill in committee.  The bill is now before the Idaho Senate. Read the Governor’s statement on both bills here.
  • Budgets continue to move through the Legislature signing the end of the session is near. The Legislature will miss its initial 3/22 “sine die” goal and is now aiming to be finished before Easter weekend.

Legislative Update 3/15/2024

  • Governor Little thanked Idaho’s budget committee for advancing his $25 million recommendation for a secure 26-bed forensic mental health facility. Read the Governor’s statement here.
  • The legislature still has a lot of bills to consider during the rest of this month. The bills are continuing to move from one legislative body to the other for committee consideration. The Medicaid budget was set today and will need to be approved by both the House and Senate.
  • Rumors are that they may end the session the week of April 1st.

Legislative Update 3/8/2024

  • Governor Little signed House Bill 428 this past week codifying a cut in unemployment insurance taxes for Idaho businesses by 20%. Read the Governor’s statement here.
  • The Governor commented on the progress of House Bill 521 which provides funding for school infrastructure while reducing taxes. Read the Governor’s statement here.
  • Governor Little shared his gratitude to the Legislature for advancing his recommendation for increased transportation funding. The budget bill would bring funding to Idaho’s 900 outdated bridges along with additional money for road maintenance and other safety projects.  Read the Governor’s statement here.
  • The 2024 legislative session is approaching an end, but Legislative leadership expect to be in session until March 29th. Leadership shared the delays have been caused by change in budget procedures and Republican House leadership.

Legislative Update 3/1/2024

  • Governor Little issued a statement earlier this week on Thomas Creech’s failed execution. The Governor stated, “…The team of professionals at IDOC was prepared for the possibility that medical professionals would not be able to access the inmate’s veins… The competent and qualified medical professionals present and IDOC officials were cautious and did the right thing in not moving forward with the execution.” Read the Governor’s full press release here
  • JFAC continues working on the budget bills and has begun setting budgets for HW, but Medicaid’s budget has not been presented yet. There have been no bills presented so far this session that would negatively affect ambulatory surgical centers.
  • Additionally, the Idaho Republican Presidential Caucus is Saturday.

Across the state, there are 210 local caucus sites, and voters must attend the local caucus site assigned to them based on their precinct. That local caucus site is probably going to be different than the local polling place Idaho voters are used to because the caucus is run by the party, not the state and county elections offices. Read more

The purpose of this legislation is to protect the rights of conscience for healthcare professionals and healthcare entities when they are asked to provide medical services which go against their conscience. Legislative Update 2/23/2024 

  • Governor Little released an update on House Bill 521 that provides $2 billion for school improvements and reduces the flat income tax rate to 5.695%.  The bill has moved to the House floor for discussion and voting. Read the Governor’s statement here.
  • The Idaho Senate has brought forward three concurrent resolutions to file Idaho’s application for an Article V constitutional convention. Each concurrent resolution addresses topics to include federal spending, congressional term limits and limiting the power of the federal government.  The constitution has never been amended by a convention of the states which would require 34 petitioning states.  If the Idaho Legislature moves forward with these actions, Idaho may become the 28th petitioning state.

Legislative Update 2/2/2024 

  • Governor Little issued a series of press releases this week about the southern border. Little reported he is sending two teams of Idaho State Troopers to the Texas-Mexico border to assist with security and receive human trafficking training.  In addition, Governor Little will attend a press conference in Texas along with 14 other Governors in response to President Biden’s policies on the southern border.  Read the Governor’s statements here and here.
  • Idaho Attorney General Raul Labrador also weighed in on the southern border and issued a statement in support of Texas and state sovereignty. Read Labrador’s statement here.
  • Governor Little issued a press release about Idaho death row inmate Thomas Creech and the Idaho Probation and Parole Board’s decision to deny a stay of his execution. Thomas Creech was convicted of five murders and admitted to participating or killing 26 other individuals. Read the Governor’s statement here.
  • House Bill 419 did not advance to the House floor for voting. This bill sought to repeal Medicaid expansion if a series of requirements were not met.
  • The committees have been reviewing agency rule changes for the last two weeks. They will begin addressing more legislation as they conclude the approval of the rules.

HB 396 MASK MANDATE PROHIBITION

This bill prevents the State of Idaho or any state officers from mandating the use of face masks, face shields or other face coverings as a means to prevent or slow the spread of an infectious disease. Read the bill here. Status – Printed and referred to House State Affairs Committee

HB 398 MEDICAID AMENDMENTS AND WAIVERS

HB 398 requires legislative approval of waivers and state plan amendments. This prohibits IDHW from seeking or implementing a Medicaid State Plan or a waiver without legislative approval provided in statute. Read the bill here. Status – Printed and referred to House Health and Welfare Committee

HB 418 ASSISTANT PHYSICIANS AND GENERAL PRACTICE LICENSURE

This bill allows an assistant physician (formerly called a “bridge physician”) to become a licensed general practitioner without entering a residency program. A candidate may apply for an unrestricted license to practice as a general practitioner after completing a minimum of three years as an assistant physician and passing the United States Medical Licensing Examination. LOOKING AHEAD

IDHW begins presenting its budget to JFAC starting on 2/13

Legislative Update 1/26/2024 

  • Governor Little joined 24 Republican governors in a statement of support for Texas Governor Abbott, the constitutional right to self-defense and securing the southern border. Read the Governors’ joint statement here.
  • Idaho’s budget setting committee known as JFAC canceled its January 26th meeting as disagreements have surfaced overrule changes within the budget setting process. JFAC must first finalize a vote on change in state employee compensation before it reviews state agency budgets.
  • Representative Redman introduced legislation, House Bill 419, that adds requirements to the Medicaid expansion program. If passed, the benchmarks must be met by July 1st of 2025 for this program to continue in Idaho. These requirements include the following:
    • Existing federal funding remain at 90%, and individuals with adjusted gross income above 100% of the federal poverty level must have the option to take the advance premium tax credit and purchase a plan on the state health insurance exchange.
    • An enrollment cap that limits the program to cover either 50,000 people or the number of Idahoans over age 65 or with a disability that have regular Medicaid coverage, whichever is lower.
    • IDHW must maintain a Medicaid improper payment rate of 5% or less, implement a lifetime benefit limit of 36 months, suspend or limit several eligibility assumptions, and implement work requirements at 20 hours per week for able-bodied adults.

HB 419 MEDICAID EXPANSION ELIGIBILITY AND FEDERAL WAIVERS

HB 419 seeks to move able-bodied Medicaid enrollees into private coverage by implementing work requirements and enrollment caps for able-bodied adults.  Additionally, the bill reduces the improper payment rate in Medicaid to 5 percent or less.  Read the bill here. SB 1227 HEALTH MEDICAL RIGHTS

This bill restricts the state and local government’s authority on advertising certain types of medicines or vaccines.  The bill also creates additional requirements for informed consent and the use of experimental drugs.  Read the bill here.  Status – Printed and referred to State Affairs Committee

Legislative Update 1/19/2024

The Legislature commenced on January 8th for the Second Regular Session of the Sixty-seventh Idaho Legislature. Governor Little presented his State of the State address and outlined his Idaho Works budget plan. Read highlights from his plan below.

  • Healthcare – Adds $447k for 8 new medical residency positions. Approximately 100 new medical residency positions have been supported over the past three years.
  • Utilizes $2 million from the opioid settlement fund to advance recommendations from the Idaho Behavioral Health Council to include investments supporting behavioral health workers and increase their capacity, as well as increasing opportunities for treatment for targeted populations.
  • Public safety – adds $25 million for the construction of a secure, forensic 26-bed mental health facility to care for patients committed and determined to be dangerously mentally ill by Idaho courts.
  • Property tax relief – $150 million in new property tax relief through the surplus eliminator.

IASCA had its legislative luncheon this week for the House and Senate Health and Welfare committee members. The Lt. Governor and the health policy advisor from the Governor’s Office also attended. Brett Maxfield gave a presentation about what surgery centers do and how they are different from hospitals. He provided information about the savings that could occur from Medicaid patients being able to better utilize independent surgery centers. We had positive feedback from the attendees.

These are the newly introduced pieces of legislation from this past week:

HB 383 MEDICAL LIENS

This bill extends the time for filing a medical lien until after a citizen’s health insurance has had the chance to process the medical costs ensuring medical providers get paid a fair value for their services. Read the bill here. Status – Printed and referred to the House Business Committee

HB 396 MASK MANDATE PROHIBITION

This bill prevents the State of Idaho or any state officers from mandating the use of face masks, face shields or other face coverings as a means to prevent or slow the spread of an infectious disease.  Read the bill here.  Status – Printed and referred to House State Affairs Committee

HB 398 MEDICAID AMENDMENTS AND WAIVERS

HB 398 requires legislative approval of waivers and state plan amendments. This prohibits IDHW from seeking or implementing a Medicaid State Plan or a waiver without legislative approval provided in statute. Read the bill here. Status – Printed and referred to House Health and Welfare Committee

SB 1227 HEALTH MEDICAL RIGHTS

This bill restricts the state and local government’s authority on advertising certain types of medicines or vaccines.  The bill also creates additional requirements for informed consent and the use of experimental drugs.  Read the bill here.  Status – Printed and referred to State Affairs Committee
